| Court awards four years imprisonment to accused for murder attempt | | | Early Times Report Jammu, Oct 19 : Principal Sessions Judge Udhampur today awarded four years imprisonment and fine Rs 8000/- to Vinod Kumar alais Dalu who was facing trial in attempt to murder case for the last 7 yrs. Principal Sessions Judge Udhampur AK Koul after hearing both the sides observed that the wounds found on the person of victim, and the weapon used by accused to cause such wounds, do show that accused meant to kill the victim. "So the act of the accused Vinod Kumar alais Dalu S/o Sansar Chand R/O Chak Road, Peedian, Chopra Shop,Udhampur squarely falls within the ambit of Section 307 RPC besides the accused has also breached Section 4 of the Arms Act by keeping a 'kirch' having a blade of the length 16 inches and width 1.5 inch. Apart from attempt to murder accused has committed an offence under section 4/25 Arms Act and he is accordingly convicted and sentence him to imprisonment for three years and fine of Rs. 5000/- u/s 307 RPC, court said. Court also added the accused is also sentenced to imprisonment for one year and fine of Rs.3000/- for commission of offence under section 4/25 Arms Act. In case of default in payment of fine, he shall undergo further imprisonment for two months and sentences shall run concurrently. According to the police case that a written report was lodged with the police alleging therein that complainant and his brother Ajit Kumar found accused assaulting their father with a sharp edged weapon near Indra Academy on the road side. On the basis of this report case was registered and after completion of investigation challan was presented.(JNF) |
