State Subject Laws

JAMMU, Dec 8: National Conference (NC) working president and Chief Minister Omar Abdullah is accusing BJP's Prime Ministerial candidate Narendra Modi of mixing up Article 370 of the Indian Constitution, which holds the state aloof from the national mainstream, with the State's residency law. "My problem is not with misinformation about this (State residency or State subject) law. It will take some time to percolate across the country. My problem is with people like Modi, who knowingly or unknowingly, I don't know which (it is), seek to sort of join Article 370 with our State subject laws," he has been saying since December 1, when Narendra Modi addressed a massive rally in Jammu.
"The State's residency laws, known as State Subject laws, have absolutely nothing to do with Article 370. The Article 370 determines the relation between the Centre and the State. It is the bridge that joins J&K with rest of the country. Our State subject laws are our own. The State subject law as it exists now is not even a post-independence product. It is a pre-independence product," he has also been saying.
Omar Abdullah only speaks the truth when he says that the State subject law as it exists now is not even a post-independence product and it is a pre-independence product, but he distorts history of theorigin of the State Subject laws during the rule of Maharaja Hari Singh. He has been saying that the Dogra administration enacted State Subject laws to bar the rich people of Punjab so that they could not buy land in the state.
Omar Abdullah must go through the history of the origin of the State Subject law before speaking on the subject that has created unjust distinctions between the people of the state and rest of the country. He should know that the Kashmiri Muslim leadership had unleashed a movement against the Dogra administration on the spurious ground that the Muslims had no representation in the administration, as qualified Muslims were not available in Kashmir. They had been asking the state government to "import educated Muslims from Punjab" so that they could man bulk of positions under the state government. The Maharaja and his administration rejected their charge, saying educated Muslims were available in the state, and, hence, there was no question of importing "educated Muslims" from the neighbouring state.
It has become customary with the Kashmiri leadership to distort facts and present a wrong picture and it is this that has created serious problems in the state.
