DB disposes PIL after IG's written apology | Sopore ambulance case | | Jammu, Oct 17: A Public Interest Litigation has been filed by two young Advocates namely Rajnish Raina and Prem Sadotra (presently Joint Secretary BAJ) seeking .I.R. no. 249/2013 against judicial officer of the State Judiciary by Police Station Sopore (Kashmir), A Division Bench of State High Court Comprising Justice Virender Singh and Justice Dhiraj Singh Thakur disposed of the PIL with the observations that IG Kashmir tendered an unqualified apology in view of the violation committed by the officers of police agency which was accepted by this Court vide order dated February 21, 2014. Division Bench further observed that to prevent any such incident in future, this Court directed Secretary Govt Home Dept to circulatre copies of the guidelines framed by the Apex Court among all the police officers of the state of J&K, subsequently an affidavit was file dby the Secy Home in that regard. Division bench further observed that taking a serious view in the matter, various orders were passed in present petition and the respondents realizing their mistake initiated steps for cancellation of the FIR in exercise of the powers vested under Rule 567 of J&K Police Rules, leading to cancellation of the FIR. Division Bench further observed that in view of the fact that FIR registered against the judicial officer stands cancelled and in view of the fact that the respondent-state and its police agencies have already taken steps to educated its officers with regard to requirement of law as can be seen from the guidelines framed by the Apex Court, this Division Bench do not wish to proceed with the PIL any further and disposed of the PIL.
