| HC allows Minister's kin to lay tin roof of Budgam house | | | early times report Srinagar, Dec 27: Jammu and Kashmir High Court today allowed family of Choudary Mohammad Ramzan, CAPD minister, to complete tin roof of a house at Humhama in central Kashmir's Budgam district. Hearing an application filed by the minister's son Asif Afzal Choudary and his relative Haji Ghulam Ahmad Wani, a single bench of the court comprising Justice Muzaffar Hussain Attar allowed the completion of tin roof after their counsel submitted that roof of the structure is already 80 percent in place and only 20 percent tin roof is to be laid. He further submitted that in view of the winter season, the house will suffer considerable damage if it remains uncovered. "In view of the submissions made by the counsel, it is provided that respondent 11 (Asif) and respondent 12 (Wani) will lay the tin roof on uncovered part of the roof." The court however said that they will not utilize green strip adjoining their land for any purpose whatsoever till further orders from the court. "Respondents 11 and 12 shall file an undertaking before the Registrar Judicial of the court that they will comply with the court order," the court said modifying the order of status quo passed by it on November 14 to this extent only. On November 14 the Court had directed maintenance of a status-quo on the house construction by senior National Conference leader and minister CAPD Choudary Mohammad Ramzan for allegedly violating master plan for a residential colony in Budgam district. Then, a bench of Justice Bansi Lal Bhat passed the directions on a petition filed by one Dr Ghulam Nabi Yatoo, a resident of Friends Enclave Humhama in the central Kashmir district. The family is alleged to have managed permission for raising the double storied residential house on two plots from Srinagar Municipal Corporation in whose jurisdiction the area falls. Under the garb of the permission, the family is said to have raised the construction in clear violation of the sanctioned master plan on the plots "after grabbing the public lane and green strip reserved for beatification of the colony." The petition has been filed against J&K State through Chief Secretary, Commissioner/ Secretary Housing and Urban Development Department, Divisional Commissioner Kashmir, Deputy Commissioner Srinagar, chairman Building Operations Controlling Authority, Ex-Registrar Cooperative Societies and incumbent chairman BOCA/Commissioner SMC, Dr G N Qasba, Chief Enforcement Officer SMC, J&K Cooperative Housing Corporation Ltd through Managing Director, chairman Friends Enclave-cum-Welfare Cooperative Humhama Heights, Choudary Mohammad Ramzan, his son Asif Afzal Choudary, Haji Ghulam Ahmad Wani of Handwara and ward Officer 33, SMC. The petitioner has sought quashing of the order permitting the family to raise the construction of the house at the site. |
