Husband denied pre-arrest bail in dowry case

Jammu, Aug 25 : Principal Sessions Judge Jammu RS Jain today rejected the pre-arrest bail application of one Sudershan Sharma for torturing his wife for dowry. According to the police case complaint was filed by Dr. Ritu Sharma in the Court of Chief Judicial Magistrate, Jammu who forwarded the same to police station Domana.
In the application it has been averred that complainant Dr. Ritu Sharma was married with accused Sudershan Sharma on 16.2.2003 and out this wedlock two children were born.
The accused also demanded money from the complainant for running some business apart from his profession but the complainant being a good wife suffered the cruel attitude of the accused just to save her married life but with the passage of time, the accused has become greedier and his behavior towards the complainant became harsher.
The accused always taunt the complainant and subject her to physical cruelty under the influence of alcohol. On 20.7.2014, the complainant went to her relatives residence at Udeywala,Jammu for attending Uthala when at 5.30 PM the accused also came on spot and started uttering
vulgar and abusive language with the complainant and thereby calling her names. That the complainant requested the accused not to create a scene in front of her relatives whereupon the accused became furious and started mishandling the complainant and beat her mercilessly with fists and blows and dragged the complainant by pulling her hairs. On seeing this, her relatives intervened and saved the complainant from the accused who left the spot but before leaving, the accused threatened that come what may he will eliminate the complainant if she did not fulfill his demands ofRs.3.00 lacs. At present, the complainant along with her two minor children is residing with the mother and that complainant has every apprehension that accused will repeat his illegal acts as he is continuously threatening the complainant of dire consequences.
On this police registered a case u/s 498-A/323. The court after hearing Adv Vikrant Singh for the accused whereas Adv Vishal Kapur for the complainant and Public Prosecutor for the state observed that The accused are misusing the concession of interim bail and are not co-operating the police nor joining the investigation. With these observations court rejected the bail application. JNF
