JAMMU, Aug 25: The recent stricture passed by the Anti Corruption Court should be an eye opener for the premium investigating agency of the state which is fast eroding its credibility in the second most corrupt state of the country. While rejecting a closure report filed by the State Vigilance Organization in a Disproportionate Assets case against one JE of PWD, Additional Sessions Judge Anticorruption Jammu, Sanjay Parihar said, "I am pained in observing that the investigation has been closed as not admitted at the behest of Central Office of Vigilance Organization, a premier agency having exclusive control of Vigilance Organization ... even supervisory officers have been found lacking in discharge of their duties of the fair investigation which they owe not only to themselves but also to the public at large".
It was not for the first time that the courts have rejected the closure report. Not very far, in February this year, Special Judge Anti-corruption Jammu Puneet Gupta had directed SVO for further investigation in an FIR registered against a senior IAS officer in alleged graft case.
The court rejected the Closure Report filed by UDR Wing of SVO with the observation that the investigation agency has not considered certain aspect of the case and the complainant can raise these pleas before the investigating agency.
As many as investigation in 4 FIRs and over dozen complaints in Jammu and double in Kashmir region are completed in which sincere and hard efforts are being made to either close the matter or exclude the name of 'few' from the list of accused. If the sources are to be believed, 14 proved cases were dropped by the Central Vigilance Office. Among 14, three were lodged in Jammu and 11 in Kashmir.
Cases booked in Jammu included those against a Gram Sewak, AEE in PDD and a brother of a former ADGP. All these cases have failed to reach any logical conclusion due to pressure from various quarters, denting the credibility of the SVO.
With less than two months to demit the office, the State Government is trying its best to close the proved corruption cases registered against Ministers, Legislatures, Bureaucrats and their relatives. If sources are to be believed, two SSPs who were known for their honesty and integrity were transferred last year from the SVO as they refused to take 'U' turn on the proved cases being investigated by them.
At present, investigation into many cases involving gross misappropriation in crores, wrongful loss to State exchequer, nepotism, abuse of official positions and DA cases have been completed as proved. However, these cases involving top officials of CA&PD, JAKFED, Relief, JDA, JMC, PWD, PHE, PDD, Forest and Revenue etc are being closed to give relief to 'faithful' government employees and close relatives of the ruling elite. A younger brother of former ADGP is being excluded from the list of accused in a CA&PD case, controversial Vinod Koul is given clean chit in a infamous Jagti Housing scam, no sincere efforts were made to vacate the stay of the High Court on trial of case involving accused Bashir Ahmed resulting posting of the said tainted officer as Tehsildar (Settlement) Jammu.
A recent registration of case against a lady college principal was due to the constant pressure from court. Similarly, in the second complaint which too was registered against a college principal, the matter was referred for departmental action as that tainted principal was once posted as PRO of the then Education Minister for one full tenure. The problem with complaints is that the findings of enquiry are not generally subject to Court's scrutiny and in house decision of senior officers are considered final. In one of the instances, a complaint was recently closed as not proved in which execution of work involving more than 10 crore of rupees was carried out on the basis of quotations only.
Meanwhile, when contacted IGP Vigilance Alok Puri, defending SVO said that generally weak cases are dropped.
The truth of the matter is Vigilance Organisation for sure works for State government as it comes under the GAD headed by CM. Without dispute, the first and perhaps last case registered against any senior most officer of the State was against Ajit Kumar, IAS which, without any doubt, was highly politically motivated.
