Jammu, Sept 13 (LNS): Principal Sessions Judge, Jammu convicted accused Ram Singh under section 304 (II) RPC and sentenced him to undergo rigorous imprisonment for five year besides imposing a fine of Rs ten thousand. Court said in case of default in depositing fine he has undergo further four month in imprisonment. The Principal Sessions Judge, Jammu Kartar Singh after hearing the arguments of the counsel for dropped the charge of 302 RPC and charged the accused instead under 304 (II) RPC. "As the accused has remained in police as well as in judicial custody since 21.12.2008 to 06.09.2013 and thus the period of detention shall be given as set-off to him for his this conviction, court observed. The Court observed according to sequence of events the accused had absolutely no pre-plan or premeditation to cause the death of the deceased. "Thus accused cannot be imputed with the intention to cause the death. Earlier the case was transferred from the Court of Sessions Judge, Reasi for trial of the accused to this Court by the order of High Court. As per prosecution case, on 14.12.2008, Police received telephonic information that Soba Ram and the accused had a tiff over food served in a feast and infuriated accused inflicted a fatal injury to the deceased with the knife resulting his death on spot. |
