Jammu, Sept 13 (LNS): Principal Sessions Judge, Jammu acquitted a couple Prem Lal and his wife both residents of Purkhoo, Jammu of the charges inflicting grievous injury against them under various sections of RPC owing to is lacking of evidences and also ordered to destroy seized weapon and blood smeared clothes of injured. After hearing the counsel Pardeep Malhotra Advocate appearing for accused and Public Prosecutor for prosecution, the Principal Sessions Judge, Jammu Kartar Singh, observed that the prosecution evidence is replete with material contradictions and statements of interested witnesses cannot be believed in the absence of corroboration from the independent witnesses, which is lacking in the present case. The accused namely Prem Lal s/o Garu Ram and his wife Pinki Devi of Purkhoo, Tehsil -Jammu are therefore, acquitted of the charges framed against them. The seized weapon of offence as well as blood stained clothes of injured and seal shall be destroyed. As per prosecution case, on 12.07.2004, the investigating officer of the police recorded the statement of one Pooja Devi that she was living with her mother Jeeto Devi. Her uncle Prem Lal and his wife Pinki Devi living separately had a tiff with them over a petty issue. Her uncle and his wife inflicted injuries on the back of her mother as a result of which, she sustained grievous injuries and fell down. An FIR No.96/2004 u/s 307/452/326/324/323/34 RPC was registered against the Prem Lal and his wife Pinki Devi.
