Jammu, Sept 30: High Court Jammu ordered the respondents to implement the order passed by Supreme Court Of India in Civil Appeal No. 952 of 2013 dated 23.01.213 titled Rajesh Gupta v/s State of Jammu & Kashmir & Others. In the instant petition, it was submitted by the petitioner that despite directions from the Supreme Court of India, the respondents have not paid him 30% of the back wages from the date of order of premature retirement till re-instatement and also the further wages from the date of re-instatement. Justice Ali Mohammad Magrey, after hearing the appellant, Rajesh Gupta, who appeared in person in the Court, passed an order "Pending disposal of the aforesaid writ petition, it is ordered by this court on 27.09.2013 as follows:- Notice to respondents returnable within four weeks. Requisites within one week. List after service is complete". Justice also ordered that " Meanwhile, respondents are directed to release 30% of the back wages from the date of premature retirement till re-instatement in compliance of the judgement of Hon'ble Supreme Court passed in the aforesaid case. They shall also consider his case for release of further wages within one month from today". The respondents in the said case are State of Jammu & Kashmir through Chief Secretary, J&K Govt., Commissioner-Secretary, General Administration Department & Commissioner-Secretary, Rural Development Department. Notice issued to the respondents on 3oth Sept. 2013 & next date of the said case has been fixed on25.10.2013. |
