| DB directs SIT for medical examination of 9 more girls | | Sexual exploitation of mentally challenged girls | | early times report Jammu, Sept 30: In a letter turned Public Interest Litigation filed by differently abled person (visually handicapped) Division Bench of the High Court comprising First Puisne Judge Justice Virender Singh and Justice Janak Raj Kotwal after going through the status report filed by the Superintendent of Police South (Incharge Special Investigating Team), took serious note of the lapse pointed out by advocate Sheikh Shakeel Ahmed who drew the attention of the court to para 3 of the enquiry report according to which only five mentally challenged girls were subjected to medical examination and rest of nine girls/inmates of Rotary Inner Wheels of Channi Rama Jammu were not examined. He stated in the open Court that he has reliable inputs that all the 14 girls were subjected to sexual abuse but only five girls were medically examined. Upon this submission senior Additional Advocate General Gagan Basotra submitted he is also not very sure about it and therefore, cannot make a categorical statement to controvert or admit the statement made by Ahmed. He, however, assured the Court that nine female inmates, if not already examined by a Board of Doctors as asked for, shall now be examined within this week only so that report in this regard is placed before the Court for its perusal. Ahmed stated that statement of four material witnesses have already been recorded under Section 164-A Cr.P.C. and the information revealed to him is that five victims were taken out of the State also but perhaps the Investigating Officer is not investigating the present case on that track at all. He submitted that in case the Prosecution Agency is directed to place on record those statements, it would facilitate the Court in passing the necessary directions in this regard. Upon this Basotra stated that he may be given two weeks' time to place all those statements on record. He also assured that on the next date of hearing another Status Report will also be filed on behalf of Superintendent of Police, City South, Jammu, with regard to up to date progress of the investigation carried out in the aforesaid criminal case. As per earlier directions of the High Court, Deputy Commissioner, Jammu Ajit Kumar Sahu also filed his personal affidavit wherein specifically stated that he, vide order No. DMJ/PS/2013-14/78-83 dated 04.09.2013, had ordered that the management of Rotary Inner Wheel Home shall be taken over by a committee, which has since been constituted headed by Additional Deputy Commissioner, Jammu, which includes two members of Rotary Inner Wheel Home also as nothing has been alleged against them with regard to the present incident. The DC further stated that he had also visited the Home on several occasions and lastly on September 27 and convened a meeting of Administration Management Committee and after taking the stock of entire situation passed certain directions as well. Today as per the earlier directions of the DB, Atul Goel SSP Jammu along with SP South Rajeshwar Jasrotia (Incharge SIT) were present in person and Director Social Welfare Jammu was also present in the Court. The DB looking into the seriousness of the issue, made it clear in the open court that Rajeshwar Jasrotia, Superintendent of Police, City South, Jammu, who is the Investigating Officer of the criminal case, shall cause his appearance along with CD file on the next date of hearing.
