DB grants 4-weeks time to divulge names of illegal occupants
PIL against alleged land-grabbing by politicians, bureaucrats
9/30/2013 9:44:01 PM
Jammu, Sept 30: In much publicized Public Interest Litigation (PIL) against alleged land grabbing by politicians, police officers, bureaucrats and land mafia in various parts of J&K Division Bench of High Court allowed four weeks further time to Commissioner/Secretary Revenue to furnish the information as per the earlier directions.
On September 4, the DB had directed the state to disclose the full particulars/identity of all the illegal occupants of the State land who had allegedly grabbed more than 20 lakh kanals of state land. The DB comprised of First Puisne Judge Justice Virender Singh and Justice Janak Raj Kotwal.
When the PIL was taken-up for consideration on Monday, advocate Sheikh Shakeel Ahmed appearing for the petitioner, Prof SK Bhalla drew the attention of the Court to the last order whereby the State was directed to divulge the identity and the names of the illegal occupants of the state land for taking a view for further course of action.
AAG HA Siddiqui appearing for the respondents stated that he has already taken up the matter with the Commissioner/Secretary Revenue Department and prayed for another four weeks time to furnish all details as asked for on or before the next date of hearing. He assured the Court that he would not ask for any further adjournment on this count at least. Upon this the DB allowed the four weeks time prayed by Siddiqui.
The PIL took a new turn today when one Ram Krishan filed an application for intervening in the PIL on the ground that he pointed out certain encroachments regarding the illegal/ unauthorized occupation of 189 kanal and one marla of state/common land at village Bhagwana Chack, Hiranagar, Kathua to the notice of Deputy Commissioner Kathua and Tehsildar Hiranagar, He claimed no action was taken against the 'powerful' encroachers. The applicant alleged that till date the expiry of more than one year the encroachment in question has not been removed as the encroachers are musclemen and resourceful person and are being shielded by the politicians and revenue officials.
The DB issued notice of this application to the state which was accepted by Siddiqui who was directed to file objections. (JNF)
