| Jammu, June 24: In a petition filed by one Abdul Rashid Wani presently posted as Junior Engineer Drainage Sub-Division-III Sewerage & Draining Dept challenging the Government Order Nodated June 4, 2014 whereby the petitioner has been repatriated from UEED, Jammu to Public Works Department, on the ground that order is tainted with malafide and is punitive having been passed pursuant to complaint of his Assistant Executive Engineer, the Vacation Judge of J&K High Court Jammu Wing Justice Janak Raj Kotwal observed that the counsel for the petitioner pointed out that petitioner is an employee of hydraulic wing having been deputed to UEED by Commissioner/Secretary PHE, Irrigation & Flood Control Dept whereas Commissioner/Secretary Housing & urban Development Dept has repatriated him to Public Works Department, which is not the parent department of the petitioner, issued notices to respondents returnable within four weeks and in the meanwhile court ordered that subject to objections and till next date before the Bench, repatriation order dated 04.06.2014 be not implemented.
