| Court directs police to expedite investigation; IO finds no substance in complaint | | | Early Times Report
SRINAGAR, June 24: A local court here today asked police officer, investigating the sexual assault allegation among others on Director Health Services Kashmir, to expedite investigation even as the cop revealed that no substance has been found in the complaint filed by the nurse so far. "The report filed by the IO indicates that steps have been taken for expediting the investigation to its logical conclusion," the court of Chief Judicial Magistrate V S Bhou observed. "The IO is directed to take steps to expedite the investigation and record any evidence produced," the CJM added. Earlier in its report, the IO said that no concrete evidence has been found so far which establishes the allegations leveled by the nurse against the DHSK and three others medical officers. In the complaint, the victim has named DrSaleem-ur-Rehman (Director Health Kashmir); DrNazirShadad (CMO Anantnag); DrArshidTak (BMO Sallar) and Dr Ashraf (Incharge Medical Superintendent Seer Anantnag) as the accused. In her compliant, she has alleged: "The SHO concerned appears to be under influence of the accused and has not been conducting the investigation in a fair and transparent manner. The complaint is not being taken cognizance of in its real spirit and scope which has prejudiced the legal rights of the complainant and in the process a wrongful gain is being provided to the accused". The complaint reads that the accused are guilty of very serious misconduct and the allegations against them are "penal in nature but the police is brushing aside the seriousness of the allegations and are helping the accused in fleeing from burnt of investigation." "The contents of the complaint disclose section 376 (punishment for offence of rape) read with section 511 (punishment for attempting to commit offences punishable with imprisonment for life or other imprisonment), 506 (punishment for criminal intimidation), 354 RPC (assault or criminal force to woman with intent to outrage her modesty) and also 501 of RPC," nurse's counsel had said. "But the SHO concerned, to dilute complaint of the complainant, booked the accused in a much lighter offence (section 354-A RPC). The SHO appears to be under influence of the four accused," the counsel has said, alleging that the IO has not been conducting the Investigation in a fair and transparent manner. "The complaint is not being taken cognizance of in its real spirit and scope which has prejudiced the legal rights of the complainant and in the process a wrongful gain is being provided to the accused." |
