HC issues contempt notice to home secy, CRPF DG
Promotion as CRPF DIG challenged

Jammu, Sept 22: In a contempt petition as regards the disobidence of August 11, 2016 high court order whereby it had ordered that the DPC proceedings would be subject to the further court orders, high court judge Janak Raj Kotwal today issued contempt notice to the union home secretary and DG of CRPF.
The petitioner's counsel submitted that after the passing of August 11, 2016 order that in the event of holding of DPC by the offical respondents, they should keep the DPC recommendation in a sealed cover vis-à-vis the private respondent but they they did not choose to do so and promoted one as DIG and empanelled two as DIG which was the patent violation of the court directions.
After hearing him and another counsel, Justice Kotwal issued contempt notice to the union home secretary and DG of CRPF.
Meanwhile, in an amended peititon filed by Sukhjit Singh and others in which they submitted that they were directly appointed as Assistant Commandants in CRPF through SSB CPO 1991 whereas other in BSF and ITBP. After their appointment, they were deputed for undergoing training in 24th Batch of Directly Appointed Gazatted Officers (DAGOs), commencing from June 30, 1993, except petitioner No 11. All the petitioners except petitioner No 11 underwent basic training together in 24th batch of DAGOs for 55 weeks. Their period of training was from June 30, 1993 to July 27, 1994 and when the petitioners had already undergone basic training after their appointment as Assistant Commandants in CRPF, the official respondents started training of the 25th DAGO batch from December 1, 1994 to January 31, 1996. Fact remains, that all the private respondents were trainees of the 25th DAGO batch 1994. As all the private respondents belong to 25th DAGO Batch and in terms of rule position, their seniority was to be fixed below the petitioners. As birth of the respondents in the cadre of Assistant Commandant of CRPF was with effect from December 1, 1994, they cannot rank senior to the petitioners.
Justice Kotwal, after hearing the two sides, said the August 11, 2016 interim direction would apply to the impugned empanelemnet and promotion orders
