| Bhatia Sons to get 2000 instead of 5000 | | DB modifies SCC award | | Jammu, Sept 28: In a petition filed by Bhatia sons against the judgment and order of Divisional Forum and State Consumer Commission whereby State Consumer Commission modified the order passed by the Divisional Forum and in addition to awarding cost of Rs 1099/- as the cost of trouser, an amount of Rs 5000 was allowed as compensation for mental harassment and financial loss.
Besides this an amount of Rs 50,000 was directed to be paid as General compensation and the petitioner was directed to deposit the said amount in the advocates' welfare fund.
Against this order an appeal was preferred. Division Bench of State High Court comprising Justice Mohammad Yaqoob Mir and Justice DS Thakur after hearing Sr. Adv DC Raina with Adv Arun Kumar appearing for the petitioner whereas complainant in person observed that complainant in his complaint, stood awarded by the State Consumer Commission refund of cost of trouser and an additional 5000/- on account of mental torture and modified the award of Rs 50,000 to 2000 and directed the 2000 would be deposited by the appellants in the Advocates Fund within a two weeks.
The background of the case is that the complainant has purchased a trouser from the Bhatia Sons and after using it for four days, the colour of the trouser faded away. Upon this, the complainant approached the petitioner who refused and complainant filed this litigation.(JNF) |
