HC directs Govt to seize all spurious drugs in state | | | Early Times Report
Srinagar, Aug 26: The Jammu and Kashmir High Court today asked state government and Central Drugs Standard Control Organization (CDSCO) to seize all drugs declared as spurious or substandard immediately in the state. "Keeping in view the seriousness of the issue in the interest of general public, we direct that state government and CDSCO shall take immediate steps so that general public may be saved from consuming these drugs which have been found to be spurious, adulterated and substandard," a division bench comprising Chief Justice M M Kumar and Justice M H Attar said "The stock as well as the supply given to the chemist in the state as well as government hospitals/ dispensaries be seized," the court said and asked the concerned authorities to file a status report by next date of hearing on 4-9-2014. "The important issue apart from others, which confronted the court was the steps taken against the companies who have been found to have supplied spurious, adulterated and substandard drugs in the state of Jammu and Kashmir," the court observed. A reference in that regard was made to the list of 99 drugs in the status report filed by controller drugs and food control organizations, it said. In the remarks column, it said, most of the time, the only action taken is that permission to prosecute the company has been granted. Upon a query by the court about what will happen to the companies during intermediate period of trial, advocate general was not able to give any satisfactory reply. "Our concern was whether these companies would continue supply of spurious/substandard drugs in the state or their agreements to supply have been cancelled by blacklisting all such companies," it said. Assistant Solicitor General S A Makroo referred in that regard to a status report filed by CDSCO, submitting that manufacturing license of the drug found to be spurious/substandard or adulterated have either been suspended or cancelled on the direction by CDSCO or direction have been issued by the concerned state where the manufacture process is undertaken. The PIL was filed by Doctors Association Kashmir last year, seeking impartial and time-bound probe into entire drug scam and nabbing of culprits involved in the heinous crime. |
