Absence of New Land Acquisition Act in J&K
PDP takes lead, submits Pvt Members Bill

Srinagar, Aug 26 : Opposition Peoples Democratic Party (PDP) today finally took the lead when it brought a private members bill in the state legislature for enactment of New Land Acquisition Act in Jammu & Kashmir which would be similar to the Central Land Acquisition Act which was enacted last year and is enforced all over the country from January this year.
The new act provides for fair compensation to the people whose land is acquired by government and other agencies for developmental projects. The new Land Acquisition Act guarantees compensation four times more than the market value of land and property in rural areas and in urban areas this compensation is double the market value of land and property.
According to reliable sources, PDP submitted the private members bill before the Assembly secretariat a few days back and the secretariat has neither rejected the bill nor accepted it as it needs some further corrections.
The main objective of the new land acquisition act is to ensure a humane, participative, informed and transparent process for land acquisition for industrialization, development of essential infrastructural facilities and urbanization with the least disturbance to the owners of the land and other affected families.
The Land Acquisition Rehabilitation and Resettlement Act ensures that just and fair compensation is provided to the affected families whose land has been acquired or is proposed to be acquired.
The NC-led Government in Jammu & Kashmir has come under serious criticism as they failed to bring a bill in the state legislature viz a viz Land Acquisition for the last many years. Due to the absence of this act in J&K the people of state are suffering a lot especially those families whose land and property was acquired a couple of years ago during land widening , construction of new roads , flyovers etc. While talking to Early Times Dr Mushtaq Ahmad Khan Chairman Centre for Rural Development said: " People of Jammu & Kashmir state are the direct losers due to the absence of new Land Acquisition Rehabilitation and Resettlement Act , because they are paid even less than the market value of their acquired land and property , while in other states affected people get double price of land and properties in urban areas and in rural areas the compensation paid is four times more than the actual market rate "
