Jammu, Feb 17: Principal Sessions Judge Reasi YP Kotwal today awarded life-imprisonment and fine Rs 10,000 to Mohd Nadir of Kanthi Mora Chan Tehsil Mahore District Reasi for murdering his wife who failed to give birth to any child. After hearing Public Prosecutor MM Sharma for the State whereas Adv KK Dubey appearing for the accused, Principal Sessions Judge Reasi YP Kotwal observed that the prosecution has proved the guilt of the accused and the circumstances are conclusive in the nature to exclude every hypothesis but the one proposed to be proved. The chain of evidence is absolutely complete. Hence, prosecution has proved the guilt of the accused beyond any shadow of doubt. Accordingly the accused is convicted u/s 302 and awarded life-imprisonment and fine Rs 10,000/-. According to the police case that on January 7, 2009 Police Post Arnas Received an information that dead body of Mst Mahroof w/o Mohd Nadir (22) was lying in a pond near accused house in suspicious condition. During the investigation police recorded statements of witnesses u/s 175 CrPC and police further found that three years back, the deceased was married to accused, however, she could not gave birth to any child, the accused used to maltreat her and wanted to contract second marriage. And under criminal conspiracy on January 6, 2009at 11:00 PM, when the deceased was sleeping, the accused strangulated her with a rope and killed her and thereafter threw the body of deceased in the pond near his house. Police registered a case u/s 302 RPC and recorded the statements u/s 164-A CrPC and after completion of investigation challan was presented in the court.(JNF) |
