Can NC afford to take a decision on the Act? | Discussion on AFSPA | | EARLY TIMES REPORT
JAMMU, Oct 4: The Armed Forces Jammu Kashmir Special Powers Act (AFJKSPA) is likely to invoke a serious discussion in the Legislative Assembly tomorrow (October 5). In the absence of Peoples Democratic Party (PDP), the National Conference has decided to play opposition as well and the Bhartiya Janata Party (BJP) has agreed. The repeal of the legislation has been ruled out by the Chief Minister and his Law Minister repeatedly.
The legislators have to take into consideration constitutionality of the Act besides its implications at the local, national and international arena.
In 2001, the Supreme Court in Naga People's Movement of Human Rights versus Union of India held: "Section 3 of AFSPA could not be construed as conferring powers to issue a declaration without any time limit."
As per the apex court ruling, it is mandatory for the union government to review the legislation and issue a fresh notification. New Delhi has failed to review the Act since August 10, 2001. This is a clear violation of the apex court judgement. The special powers enjoyed by the arm... | |

NEW DELHI, Oct 4: IAF chief Air Chief Marshal PV Naik justified the need for the Armed Forces Special Powers Act (AFSPA), whose removal has been demanded by the Jammu and Kashmir government, saying "legal protection" is a must for the troops to efficiently perform their tasks.
He was addressing a press conference on the force's Annual Day in New Delhi.
"A soldier fighting anywhere at the request of the government and not voluntarily, must have legal protection otherwise he would be left inefficient to complete the job in which either the central or the state government has interest in," Air Chief Marshal PV Naik said .

MUMBAI, Oct 4: Three persons, including two from Jammu and Kashmir, have been arrested by narcotics control bureau (NCB) in Maharashtra's Thane district along with 61 kilograms of charas.
The estimated cost of the seized charas was put at Rs 8 million by NCB.
The arrests were made last Friday at Kharegaon following a tip-off, according to NCB zonal director Yashodhan Wanage.
He said a truck driven by Shaukat Ali and Asif, both residents of Jammu and Kashmir, was intercepted and searched, and the drugs found concealed in specially made cavities in the roof of the driver's cabin.
The consignment and the truck were seized and the accused apprehended, he added.
